Van der Elst visa – A unique type of visa
The EU directive of free trade within the EU allows companies which are based in one EU member state to provide their services throughout the entire EU. This included the right and opportunity to also use non-EU-employees for the work in the other EU state without needing to obtain an additional work permit for the hosting country.
To give an example, a company based in France post their employees with Indian passports to Germany, to the carry out work for a German client. Depending on the circumstances and the deputation period, some EU countries even allow this people movement and engagement without a separate visa, but only request a formal registration of the work to be carried out by the non-EU national for the relevant period.
