Inheritance Law constitutes a branch of Private Law.
Inheritance law governs the management and distribution of the assets (and/or debts) of the deceased, which will be entrusted to successors, as defined by law or by will.
Under German law, the heirs of a property are defined by family relationships. Depending on the heir’s position in the family tree, close relatives can exclude the other relatives within the same bloodline.
Children and spouses usually take precedence over the other family members. Provided that the right of the closest relatives (called legitimate or forced heirs) is respected, the legal order of succession can be modified by will or succession agreement.
The advice of a legal expert is always recommended to ensure compliance with the testator’ wish and/or with the requirements established by law.
